Same-sex marriage registration in Thailand

Thailand is the first ASEAN country and the third in Asia to pass an equal marriage law that allows same-sex marriage. This law allows anyone aged 18 and above to legally register for marriage or divorce. Same-sex couples who are foreign nationals or couples between foreign nationals and Thai citizens will be able to register their marriage in Thailand. The term “spouses” is no longer restricted to male-female couples but extends to all genders. Regardless of gender identity or expression, individuals who register their marriage are legally recognized as “spouses.” 

If a same-sex couple marries in Thailand, but one or both partners are from countries where same-sex marriage is not legally recognized, it is advisable to check the laws of the foreign national’s home country as several implications may arise.

REQUIRED DOCUMENTS

Thai Nationals
  • Valid Thai National ID
  • House Registration Documents
  • Other certificates relating to family status record such as previous marriage and divorce certificate, name or last name change certificate etc.
Foreign Nationals
  • Valid passports
  • Certified copy of passport by embassy (visa page is not needed)
  • Affirmation of Freedom to Marry or Certificate of No Impediment to Marriage, obtained from the respective embassy or consulate in Thailand
  • Certified translation of the certified passport and the affirmation
  • The certified passport and the affirmation with their translation legalized by Thai Ministry of Foreign Affairs

SAME-SEX MARRIAGE REGISTRATION PROCESS

  • Both parties must appear in person at any district office (Amphur) in Thailand.
  • Submit the required documents to the registrar.
  • Complete and sign the marriage registration forms provided by the district office.
  • The registrar will review the documents and register the marriage, only if everything is in order.
  • A marriage certificate will be issued upon successful registration.
