Under Thai Law, all foreigners wishing to work in Thailand must hold a valid work permit issued by the Ministry of Labor.
A Work Permit defines the locality, length of time permitted to work, category or nature of work and the employer details.
Many foreigners will try to work in Thailand without a valid work permit. We certainly do not recommend this as it consequently constitutes a criminal offense and penalties are quite severe. Failure to comply with Thailand’s Employment regulations is punishable by fines and/or imprisonment. As a result, the Royal Thai Immigration Police will usually deport such foreigner.
Important points to consider when applying for a Work Permit
-A company can hire one foreigner for every 2,000,000 Baht registered paid-up capital. Furthermore, one company shall only be allowed up to 10 work permits. However, certain considerations apply in certain situations.
-There are compulsory requirements for a minimum number of Thai employees per foreign employee depending on the status of the company. The standard ratio is 4 Thai employees to 1 foreign employee.
-TAX and Social Security Funds are compulsory paid by every company. Therefore, companies who are not complying with the laws of Business Development and Revenue Department are not eligible to apply for a work permit for you.
The first step in the work permit application process is to obtain the correct visa. In most cases, the applicant need to apply for a Non-Immigrant Type “B” Visa. You can obtain this type of visa in your home country or in any Thailand’s neighboring countries. This will allow the applicant to stay in Thailand for the first 90 days. This shall give ample time for work permit application to take place. A Work Permit is valid for up to one year and is renewable yearly.
Securing a work permit is a complex procedure where strict guidance applies. Therefore, you need to consult with a lawyer to assess if you are eligible under Thai law to apply for a work permit.
